Will a tent provide some protection from bears?
+1 for the psychological aspect. Even if it isn't necessarily safer, you can feel safer in a tent which leads to more rest, etc.

Agreed. I also don't think we want to be giving this sort of legal advice in general. Laws have a tendency to change, and there are better outlets for tracking legal issues. They do try to sum them up here.
